  • What Are Your Rights When Arrested?

No one wants to end up in police custody. Getting legal help from a lawyer is essential if you are arrested because an attorney understands and empathizes with the multitude of issues and experiences the victim has to go through. Nowadays, it is very easy to access the coordinates of a Miami criminal defense attorney, who can offer you professional legal guidance that will help you a long way. In arrest situations, law enforcement officers have the duty during such a process to treat every person fairly, no matter their race, nation, or religious beliefs. The officers have to advise the suspect of their constitutional rights before questioning them. The defendant can be protected from the beginning under the protection of Miranda Rights. Getting Arrested The police must recite the Miranda Rights when a suspect is taken into custody. They need to inform you of your right to remain silent until a lawyer is present before any interrogation is conducted. You do not have to be handcuffed and hauled off to jail or the police station in order to be "in custody." A person is "in custody" when they are arrested or when their freedom of movement is significantly restricted to the degree associated with a formal arrest. This determination is made in light of all the circumstances surrounding the encounter with the police. If a reasonable person would not feel free to walk away, then the suspect was in custody, and Miranda Rights apply. But what do Miranda Rights actually mean? In 1966, in the case of Miranda versus Arizona, the Supreme Court held that the police must advise a suspect in custody about their constitutional rights. You have surely heard countless times in police movies about these rights secured by the Fifth and Sixth Amendments to the Constitution, but what is their meaning? The Right to Remain Silent At the arrested moment, you have to speak up to invoke your right to remain silent under the fifth amendment of the United States Constitution. It would be best if you said, for example: "I wish to remain silent. I have nothing to say. I do not want to answer any questions. I do not want to talk until I have spoken to a lawyer." Silence- even prolonged silence- is not enough to invoke your right to remain silent. It would be best if you spoke up and unambiguously announced that you would not speak to the officers. The Right Not to Make Any Self-Incriminating Statement With a calm and conciliatory attitude, you must decide to be quite known. This decision can make a huge difference in protecting individuals against self-incrimination. Otherwise, what you can say becomes evidence in a trial against you at a court of law. If you are arrested, it's important not to resist the arrest, even if you think it is unfair. This can be used against you, as it is seen as an incriminating act. The best time to assert your rights is immediately after the Miranda rights are presented to you. You may, though, assert these rights at any time during police questioning, even if you have already answered some questions or made other statements. That is why it is necessary to quickly request access to an attorney because a criminal defense attorney will provide a robust defense and make sure that you don't say anything that can incriminate you at the trial. The Right to an Attorney The second you have contact with a police officer after you are brought in for questioning is to state that you would like an attorney calmly. That one statement triggers a set of powerful constitutional protections for you. If you cannot afford an attorney, one will be provided to you at no cost. Once you say the word "attorney," the police must stop questioning you. Your request for a lawyer is your constitutional right. Do not give any explanation or pretext, say nothing, sign anything or make any decision without a lawyer. You have the right to make one local call; if you still need to do it, now is the time to call a lawyer. An attorney can make a big difference in your case because they can get the charges against you reduced or dismissed. So, contact an attorney as soon as you're allowed to after you've been arrested. After an arrest, the best thing you can do is to be proactive about your case, keep your mental balance and let your attorney explore every possible option available for your defense. By ML Staff. • Dubyuhnell, Julia Shining Prove Best in Aqueduct Preps for Kentucky Derby, Oaks

Dubyuhnell entered Saturday's $250,000 off a maiden win in the slop at Aqueduct and thrived under in similar conditions to edge long-time leader Arctic Arrogance in Saturday's $250,000 Remsen (G2) for two-year-olds. A pace-pressing second for much of the 1 1/8-mile journey under Jose Ortiz, Dubyuhnell outstayed Arctic Arrogance by a half-length. Owned by West Paces Racing and breeder Stonestreet Stables, Dubyuhnell returned $10 after completing the course in 1:50.88. "He was drawing off. I think we were pretty lucky he does want to get the distance," trainer Danny Gargan said. "We just have to stay sound and stay lucky and keep picking the right races. Maybe we'll be somewhere in May." There was a gap of more than 11 lengths between Arctic Arrogance and Tuskegee Airmen, who went off favored at approximate odds of 13-10. Quick to Accuse finished fourth and was followed by Midnight Trouble, Il Miracolo, and Prove Right. Dubyuhnell earned 10 qualifying points toward the 2023 Kentucky Derby (G1). Arctic Arrogance earned four points, Tuskegee Airmen three points, Quick to Accuse two points, and Midnight Trouble one point. This was the second win in three starts for Dubyuhnell, who finished fourth on debut at Saratoga to Instant Coffee, recent winner of the Kentucky Jockey Club (G2) at Churchill Downs. He rebounded with the aforementioned maiden win at Aqueduct by 2 1/2 lengths, his first start sporting blinkers. "We'll take him down to Florida because of the weather and we won't have to miss as much training," Gargan said. "I'm not ruling out that he couldn't come back for the Withers (G3), we don't know yet. I'd love to win the Wood Memorial (G2), it's one of my favorite races. There's no plans for where he'll go next but we could see him here for the Withers." Bred in Kentucky, Dubyuhnell is by 2017 juvenile champion Good Magic and out of the multiple Grade 3-winning Wild Gams, a daughter of Forest Wildcat who has also produced this year's Nearctic (G2) winner Cazadero. Julia Shining remains a work in progress after hopping on the 2023 Kentucky Oaks (G1) trail with a green, come-from-behind victory in Saturday's $250,000 Demoiselle (G2). A full sister to Malathaat, who parlayed a win in the 2020 Demoiselle to a victory in the 2021 Kentucky Oaks and a division championship, Julia Shining raced very wide and as much as eight lengths off of a slow pace in the 1 1/8-mile fixture. Encouraged hard by jockey Luis Saez throughout the final half-mile, Julia Shining finally made a progress with a wide rally into the stretch and eventually won by a neck as the favorite at approximately 1-2. "There's a lot of similarities," trainer Todd Pletcher said comparing Julia Shining with Malathaat, who recently retired after winning the Breeders' Cup Distaff (G1) and a likely second Eclipse Award. "She's still figuring things out. We knew she wouldn't like the kickback, and I don't think she really liked the surface on top of that. It took her a long time to finally get into a rhythm." A homebred racing for Stonestreet, Julia Shining paid $3.10 after completing one lap of the Big A in 1:53.05. Affirmative Lady finished second by three parts of a length over another Pletcher trainee, Gambling Girl. The order of finish was rounded out by Royal Spa, La Vita Sofia, Foggy Night, and Tribal Queen. Julia Shining earned 10 qualifying points on the road to the Kentucky Oaks. Affirmative Lady, who remains a maiden after three starts, earned four points. Gambling Girl secured three points, Royal Spa two points, and La Vita Sofia one point. Julia Shining is now 2-for-2. She demonstrated similar greenness when taking her debut at Keeneland on Oct. 16, falling well the pace but rallying to win going away by 2 3/4 lengths going about seven furlongs. Bred in Kentucky, Julia Shining is by Curlin and out of Grade 1 winner Dreaming of Julia, a daughter of A.P. Indy and the multiple Grade 1-winning sprinter Dream Rush. • "A Surrealist Stay” at Mr. C Hotel Miami - Coconut Grove Presented by JO-HS Gallery

JO-HS Gallery is pleased to present their presentation of artists curated for Mr. C Miami - Coconut Grove by Cipriani uniquely for Miami Art Week 2022. JO-HS is a gallery, design space, and artist studio residency located in Mexico City with offices in New York and Geneva. JO-HS works primarily with emerging contemporary artists supporting them with the production, exhibition, and distribution of their art. The curated concept of “A Surrealist Stay” will include a mix of sculpture, ceramic and installation work with three main artists exhibited throughout the Mr. C Miami hotel, including Celeste, Ramiro Gonzales Luna and Demit Omphroy. “A Surrealist Stay” plays tribute to the small provençal hotel La Colombe d’Or in Saint Paul de Vence, in the South of France where artists from all over Europe, Matisse, Picasso, Calder and many more artists would make their way to stay. They didn’t always have enough money to pay their bill so the hotel would let them leave an artwork behind in exchange for their stay. It soon began attracting colorful characters from the nearby region, such as the Fitzgeralds, who were summering at their beach villa half an hour south, cavorting with Hemingway and friends in Antibes. In fact, Scott and Zelda once had a jealous row over Isadora Duncan at the Colombe d’Or. Mr. C Miami has a rich history behind its glamorous and beautiful setting in Coconut Grove. This initial art initiative will aim to create a narrative and story tying the works on display into the pillars of the hotel and the art fair taking place simultaneously. The selection of artists chosen for Mr. C Miami - Coconut Grove work in various mediums, which will aim to highlight the story of the famous Bellini cocktail and Mr. C with custom plates for the restaurant area and a surrealist sculpture made by contemporary painter Demit Omphroy. A cocktail party and intimate dinner to celebrate the exhibition will take place on Tuesday, November 29th. More on JO-HS JO-HS is a gallery, design space and artist studio residency located in Mexico City with offices in New York City and Geneva, Switzerland. JO-HS works primarily with emerging contemporary artists supporting them with the production, exhibition and distribution of their art. Ramiro Gonzalez Luna / Part-time Ceramist (b.1996, Mexico City) Ramiro Gonzalez Luna lives and works in Mexico City and he describes himself as a “part-time ceramist”. The inspiration behind his ashtrays is drawn from the idea of left-behind objects of the everyday, and above all, he focuses on the remains left on ashtrays after a party. To him, as it is with trash, you can tell plenty about a person depending on what they leave behind. Each ashtray is unique, just as every one of us. Ramiro re-creates this party mood and its corresponding atmosphere, which of course ponders on issues such as addictions, fast food, and drugs, among other issues. He has exhibited these ceramics recently at Peana in Mexico City, SUMA Gallery and UVNT Art Fair, Madrid. Demit Omphroy studied art at the University of California, Berkeley. After college, he played professional soccer for a few years before diving into a career of photography and filmmaking. Painting was always a constant passion throughout the different stages of his life. Omphroy’s style can best be described through playful figures and movement, paired with bold primary colors. Demit has been fascinated by the concept of eternal youth living inside of everyone. He believes as people get older, it is imperative to maintain and nurture that inner child; free to make mistakes, free to create without boundaries. Celeste is an artist duo formed by María Fernanda Camarena (Guadalajara, 1988) and Gabriel Rosas Alemán (Ciudad de México, 1983). Celeste’s art practice combines diverse medias and disciplines, encompassing multiple collaborators and spectators within the workings of intimate exchange. Transient moments of proximity and familiarity blur the commonplace structures that define the way artworks should be appreciated and exhibited in museums and gallery spaces. Today, almost 90 years later, brothers Ignazio and Maggio Cipriani have drawn on their rich family history to create the luxury hospitality and residential brand known as Mr. C. Cipriani is internationally renowned for its restaurants, hotels, members clubs, and residences with locations in metropolitan destinations including Beverly Hills, Manhattan, and Miami.
