Karen Cliche's career is a testament to embracing life's evolving chapters with confidence and purpose. After captivating audiences in fan-favorite series including Adventure Inc., Mutant X, Young Blades, and Flash Gordon, and leaving her mark on the Saw franchise, the Canadian actress stepped away from the spotlight to focus on motherhood. Today, she's enjoying an exciting return to the screen with an impressive lineup of projects, including Eli Roth's Ice Cream Man, MGM+'s The Westies, and The Bookie and the Bruiser. In this exclusive interview with Miami Living Magazine, Karen reflects on her return to acting and the exciting new chapter unfolding both on and off the screen. Miami Living (ML): Welcome Karen, it's such a pleasure to have you with us. This has been such an exciting chapter in your career, with Ice Cream Man, The Westies, and The Bookie and the Bruiser all arriving in such a short span of time. Does this current chapter feel like a continuation of the journey you've always imagined, or has it taken you in directions you never expected? Karen: I call this part of my life “post career interrupted” , after taking 12 years away from the biz to raise my daughter. So it is a continuation of sorts but I feel so different, it seems like a whole separate chapter for me. I am excited about the juicier roles, the deeper dive into what I am capable of after so much more lived experience. ML: You first worked with Eli Roth on Thanksgiving, and now you've reunited with him for Ice Cream Man. What's something you've come to appreciate about him as a filmmaker that made you excited to collaborate with him again? Karen: I adore Eli! He is like a kid in a candy shop…or an ice cream shop ;) when he directs or talks horror. He is right there with us when we are filming and loves the genre so much, you and the fans really feel it comes from a genuine passionate place. I also got to act with him this time, playing a married couple so that was such a treat. Especially since he is so good at improv, we had a blast. ML: You've had the opportunity to work across so many different genres throughout your career, but horror has become such a memorable part of your journey. What is it about the genre that keeps you coming back to it? Karen: It’s funny, I started my career in comedy, then action, then horror. All 3 require a letting go and pushing yourself hard. There is no “phoning it in” . To sell it means to immerse yourself completely in it and I love that. I also have come to love and appreciate horror fans too, they are so lovely when I meet them and have really inspired me to think about watching more horror films…. Though I would prefer to stick to acting in them! ML: Your recent projects have paired you with an incredible lineup of actors, from Patrick Dempsey and J.K. Simmons to Vince Vaughn and Theo James. Is there someone you've worked with recently who surprised you in the best possible way, either on set or between takes? Karen: I had never worked with Vince before and we had such great chemistry and we were in the hands of the incredible S.Craig Zahler who allowed us to take our time and indulge in non verbals, long beats, and undertone more than the dialogue itself. It was such a collaborative effort and he is sitting so close to you in the scenes, right there with you. I had such a great experience on the film, I can’t wait for you to see it. ML: When you returned to acting after taking time away for your family, did it feel like picking up where you left off, or did it feel like beginning an entirely new chapter? Karen: I couldn’t get arrested the first year back! Crickets. Nada. I was about to give up and say “hey well I tried! It’s too late, no one wants me anymore.” But then I made a big personal decision to leave my marriage and that unlocked some kind of universal energy and I started working again right away. And as I get older, I am excited about the types of roles available to me. Yes they are way less….but I think the world is more open now to female leads in their 40’s/50’s, as sexy strong women. I am looking forward to that. ML: Beyond your work on screen, you've dedicated time to advocating against sex trafficking and supporting women's issues. How did you first become involved in this work, and what has it taught you over the years? Karen: I was always a feminist - someone who wanted equal rights and safety as a woman. Who wouldn’t? I can’t believe how any women still say they aren’t. Makes no sense to me! I grew up in domestic violence and felt the injustice very strongly early on, so I started volunteering at women’s shelters at 18, as a receptionist, then in different cities I lived in, as a cleaner of second stage apartments, food banks, etc. Anything that could help. My mom left with nothing when my sister and I were 12/13 years old and we rebuilt a life. She is my inspiration and I wanted to share that hope with other women and girls too. I sponsored a couple of girls in Thailand and The Philippines to at least save them from the huge sex tourism industry there. ML: As you look at this newest chapter of your career, what feels different today compared to the actress who first stepped onto a professional set all those years ago? Karen: I wasn’t comfortable with vulnerability when I was younger. Hence why I was able to play “tough girls” so well. Since becoming a mom 17 yrs ago and having lived so many hardships but also so much love, I broke open and I now can access these emotions so easily, without fear. A $30 million penthouse sale has placed Faena Residences Miami at a defining point in the Miami River’s evolution. The transaction, the largest residential sale ever recorded along the river, suggests that buyers are beginning to view the area as a luxury waterfront destination in its own right. The record is only part of the story. As Faena’s first standalone condominium development, the project brings its residential philosophy to two towers designed by Rafael Viñoly, connected by the 45,000-square-foot Faena Rose Cultural Center. The result offers a closer look at how the brand intends to translate its cultural identity into daily life at home. In this conversation, Harvey Daniels, vice president of development sales at Fortune International Group, explains what drew the buyer to the penthouse and why the Miami River was chosen for the project. He also discusses the thinking behind the Faena Rose patron community and the waterfront details that have received less attention. Harvey Daniels, vice president of development sales at Fortune International Group. Miami Living (ML): The $30 million penthouse set a record for the Miami River. What do you think ultimately convinced the buyer to make that investment? Harvey Daniels: We believe the sale reflects the unique combination of factors that Faena Residences Miami brings together. The penthouse itself is extraordinary, with 8,184 square feet of interior space, nearly 7,000 square feet outdoors, a private rooftop pool and expansive views across the river, Biscayne Bay and the Miami skyline. But buyers at this level are looking beyond square footage. They’re investing in the Faena lifestyle, the design pedigree, the services and the opportunity to be part of what we believe will become one of Miami’s next great waterfront destinations. At approximately $3,665 per interior square foot, the sale establishes an entirely new benchmark for the Miami River. ML: Faena Residences Miami is the brand's first standalone condominium project. What makes this development different from other luxury residential towers in Miami? Harvey Daniels: What makes it different is that it isn’t conceived as simply two residential towers with amenities added around them. It is being developed as a complete Faena environment where architecture, art, culture, wellness, hospitality and waterfront living are integrated into everyday life. It also brings together an exceptional creative team led by and in close collaboration with Alan Faena. The towers are among the final works of Rafael Viñoly, while the interiors have been shaped through a collaboration between Bryan O’Sullivan Studio and artist Andrés Reisinger. Landscape architecture is by Sasaki, wellness programming is being developed with Inge Theron, and artists including Reisinger and Juan Gatti are creating work specifically for the project. ML: Why did Faena choose the Miami River for this landmark project, and what do you see as the area's future over the next decade? Harvey Daniels: The Miami River has everything that has historically made Miami’s great neighborhoods successful with water, connectivity, proximity to the urban core and a strong sense of place. Yet it still has tremendous room to evolve. Faena has a history of identifying places with untapped potential and helping create destinations around culture and community. The site is directly across from Brickell, minutes from Biscayne Bay and connected to the city by both land and water. The project is also helping complete an important stretch of the Miami Riverwalk. The $30 million penthouse sale is significant because it shows that buyers are already recognizing that potential. We believe the next decade will see the river emerge as a true luxury waterfront neighborhood in its own right rather than simply an extension of Brickell. ML: Can you explain the vision behind the Faena Rose Cultural Center and the experiences it will bring to residents and the Faena Rose patron community? Harvey Daniels: The Faena Rose Cultural Center is really the heart of the project. Rather than creating a conventional amenity deck, the vision was to create a cultural and social destination connecting the two residential towers. At approximately 45,000 square feet, it will bring together spaces for dining, wellness, entertainment, creativity and gathering, including a restaurant and bar, library, screening and billiards spaces, creative suites, fitness and wellness offerings and outdoor terraces. It is designed to encourage residents and the Faena Rose patron community to participate, connect and experience culture as part of everyday life rather than only on special occasions. ML: How does the Faena Rose patron community differ from a traditional private members' club, and what role does it play within the development? Harvey Daniels: We think of Faena Rose as a patron community rather than a traditional members’ club. The emphasis is on participation in culture, ideas and experiences and on bringing together people with a shared curiosity about art, design and the world around them. Within Faena Residences Miami, that philosophy helps create a genuine sense of community. The Cultural Center becomes a setting for programming, conversations, performances and shared experiences rather than simply another collection of private amenities. ML: Beyond luxury amenities, how have art, culture, and wellness been integrated into the daily living experience at Faena Residences Miami? Harvey Daniels: They were part of the project from the beginning rather than treated as additions. Art is integrated into the architecture through commissions by artists including Andrés Reisinger and Juan Gatti. Wellness extends beyond a gym or spa through programming developed with Inge Theron and spaces designed around movement, restoration and wellbeing. Culture is centered within the Faena Rose Cultural Center and its programming. Even the arrival, landscaping and waterfront experience have been designed to contribute to that larger sense of place. The goal is for residents to encounter art, culture and wellness naturally throughout their day. ML: What type of buyer has shown the greatest interest in Faena Residences Miami, and what are they looking for that they aren't finding elsewhere? Harvey Daniels: We’re seeing sophisticated domestic and international buyers who already understand Miami and have very high expectations for design, service and lifestyle. At this end of the market, buyers have access to extraordinary properties almost anywhere. What they are increasingly looking for is meaningful experiences, culture, community and a strong identity. Faena offers that. Buyers are choosing to live among like-minded individuals who prioritize cultural experiences, a level of hospitality and programming that has already been established through the Faena brand. ML: What details about Faena Residences Miami have been overlooked in media coverage but deserve more attention? Harvey Daniels: The waterfront experience is one. Faena Residences Miami will have one of the longest continuous private residential docks on the Miami River, with marine services that allow residents to move between the river, Biscayne Bay and Miami Beach by water. The public realm is another. The site plays an important role in extending the Miami Riverwalk, so the project’s impact extends beyond its residents. And finally, the creative collaboration deserves more attention. What’s the difference between adoption and conservatorship? Millions of dollars and the freedom to make your own choices, if you ask retired football player Michael Oher. Matthew Sharpe/Getty Images Oher, whose story was made into the 2009 movie “The Blind Side,” says he believed he signed papers to be adopted by an affluent white couple, Sean and Leigh Anne Tuohy, in 2004. But papers filed in court recently indicate Oher was in fact never adopted. Rather, he has been under a court-imposed conservatorship all this time. Further, it is alleged that the arrangement allowed the Tuohys to “gain financial advantages” by striking deals in Oher’s name. The Tuohys’ attorneys have pushed back, saying that Oher had long known he wasn’t formally adopted and that the conservatorship was necessary for his college football aspirations. Their current attorney has also said he believes the long timeline for getting an adoption – compared with the relatively speedy conservatorship process – played a role in their decision. As the high-profile legal drama continues to unfold, Leigh Anne Tuohy’s personal website still describes Michael Oher as the couple’s “adopted son.” As a law school professor who teaches trusts and estates as well as family law, I have been intrigued by the precise connections between the Tuohys and Oher. A conservatorship and an adoption are two very different legal proceedings, and the resulting relationships are entirely distinct. What is a conservatorship? Conservatorships are legal mechanisms to help people who can’t care for themselves or their finances – for example, due to advanced dementia. They’re typically not for people like Oher who have been signing their own contracts or writing their own books. The goal is to protect a vulnerable person’s well-being and their assets from being misused. Another recent conservatorship in the news, that of Britney Spears, was also the subject of contentious legal proceedings, although the conservator in that case was her father. Adoption is a different legal process that results in a new parent-child relationship. Parents have certain rights and responsibilities for their children, but once a child turns 18 – regardless of whether they are adopted – they are legal adults: They can make their own medical decisions, enter into their own contracts and get married without any parental involvement. People in conservatorships don’t typically have the same kind of freedom. In Tennessee, where the Tuohys live, parents are not required to support their children once they graduate from high school. But the existence of a parent-child relationship remains meaningful even after a child turns 18. For example, parents and children may have legal inheritance rights, or children may be required to pay for a parent’s necessities. The Tuohys say they were told that they couldn’t adopt an adult. But under Tennessee law, as in many other states, adoption can take place at any age. To be sure, in Tennessee, anyone 14 or older needs to consent for the adoption to take place. So Oher would have had to agree – which he says he thought he did. In addition, adoption typically requires ending the rights of the birth parents, which can be done either voluntarily or through a termination hearing. So even though Oher was over 18, the Tuohys could have adopted him – but that probably would have required ending the parental rights of Denise Oher, Michael Oher’s mother. Tuohys’ relationship to Oher The Tuohys didn’t file for adoption. Rather, they asked a court to appoint them Oher’s conservators, which it did. Only a court can impose a conservatorship, and only a court can terminate one. A handful of states explicitly allow for a “voluntary” conservatorship – that is, one to which the person subject to the conservatorship agrees. Others, including Tennessee, seem to allow that implicitly, providing for special procedures when the person joins the petition. That appears to be what happened with Oher: He joined in the request for a conservatorship, and so did his birth mother. At issue is whether he knew he was doing so. Although Tennessee law requires that the court find an individual “fully or partially disabled and … in need of assistance” before issuing the order on conservatorship, there do not seem to have been any claims that Oher could not manage his own finances, health or living situation. The court apparently found that it was in Oher’s “best interest.” Nonetheless, the Tuohys were apparently given authority to act on behalf of Oher. Although they were appointed “conservators of the person,” which typically does not include control over finances, they were also given authority to approve any contract that Oher wished to sign. It’s unclear just what financial arrangements they undertook, other than those that Oher alleges related to “The Blind Side” – he claims that a deal saw the Tuohys receive millions of dollars in royalties from the film. An attorney for the Tuohys strongly denied exploiting Oher, describing the lawsuit as a “shakedown”; they are reportedly preparing a legal response. Little oversight Conservatorships – also called guardianships in some states – can be useful to help people who cannot make their own decisions. Even then, to protect the individual’s autonomy, states typically require that conservators be given the least amount of power possible. But there is typically very little oversight over conservatorships. Generally, a conservator is supposed to provide an annual report to the court. Under-resourced courts, however, may not be able to monitor the guardianship. It isn’t even clear how many conservatorships exist in the U.S., due to uneven record-keeping. There are alternatives to guardianships. In advance of any incapacity, an individual can designate a trusted person, known as an “agent,” to act on their behalf through advance medical directives or financial powers of attorney. Another option is supported decision-making, in which the individual retains decision-making authority but receives help from other people. These arrangements can be informal or written as contracts. Oher’s options Oher has already asked the court to compel the Tuohys to stop using his name and image, to provide an accounting of – and an end to – the conservatorship, and to return any money which should have been paid to Oher. He is seeking information about his school records and any contracts related to the movie. Outside of the conservatorship system, Oher could sue for damages in the event of any breach of fiduciary duty or fraud. When all the smoke is cleared, maybe Oher can persuade Hollywood to make a sequel to “The Blind Side” about his struggle with the conservatorship system. Every time she releases a new album, journalists and social media commentary insist that Madonna is over. They are usually, eventually, proven wrong. This debate has emerged again now Madonna is on the promotional circuit for her new album Confessions II. Despite the positive response to the music released so far, she is drawing controversy for her appearance and performances – surprise. Madonna’s contribution to music was never simply the hit records. It was demonstrating that a woman at the centre of popular culture could have an audacity that matched any applauded (male) rockstar. Now, just as it was back in the 1980s and early 1990s, that quality feels scarce in contemporary mainstream pop music. There are many more female artists in the 2020s, but there is no one as iconoclastic as Madonna, more than 40 years on from her debut. This is not to say today’s female artists lack talent. Quite the opposite. Popular music is filled with extraordinary singers, writers and performers (see Sabrina Carpenter, Taylor Swift, Ariana Grande et al). They are well-oiled, slick, inoffensive and easy to imagine the parental approval of teenage fans. Madonna built her career by refusing precisely that approach. Madonna at the start of her global success in 1983. Album/Alamy From 1984’s Like A Virgin until the present day, she has made art that potentially jeopardised safe commercial success that became culturally significant because of its audacity. Some projects did not perform as expected: 2019’s Madame X did not connect with many. Some attracted furious criticism: 2005’s Hung Up created a cultural debate about the ageist sexism in early 2000s music. Others were misunderstood for years before being reassessed: 2003’s American Life was ahead of its time with its critique of George W. Bush and early noughties US society. The point is not that every provocation succeeded artistically. It is that she accepted the possibility of failure as the price of remaining culturally significant and having the audacity to say something beyond the solid harmonies and fantastic melodies. Madonna had a message and meaning. For women, significance beyond representation The music industry has never been especially comfortable with women exercising power over both their image and their business. Female artists continue to encounter double standards around ageing, sexuality and ambition that male performers rarely experience. Madonna - Confessions II, the Film. Courtesy of Madonna Madonna did not dismantle these structures. Instead, she repeatedly exposed them. The imagery for the Confessions II album shows Madonna in outfits she would have worn 35 years ago, and her refusal to acquiesce to society’s views of what a 68-year-old woman should wear, is exactly the reason she has an army of female fans supporting her, and why she matters. It isn’t the simple fact she is a woman, and improves the quota of female artists, it is the fact she is a woman with opinions and a provocative mind that matters. Her importance to queer audiences Long before LGBTQ+ identities gained mainstream acceptance, Madonna treated queer culture as a source of artistic innovation and fought for the community. She employed queer dancers, collaborated with gay creatives during the Aids crisis and brought elements of queer “ballroom” culture into mainstream visibility through Vogue. Those choices have since generated important debates about appropriation and cultural credit, particularly regarding the Black and Latino communities that created ballroom culture. Those criticisms deserve serious attention. But they should not obscure the fact that Madonna used unprecedented levels of mainstream visibility to platform queer aesthetics and queer people to audiences who might otherwise never have encountered them. Now, 35 years on and her new Confessions II album is positioned directly to her gay audience; the project is sponsored by queer dating app Grindr and she is tapping into Pride month performances to launch the record. This strategic partnership with Grindr is a first for the music industry, and given the salacious perceptions of the app, and the music videos and performances so far, it is clear this album is audaciously using a “sex sells” strategy for a 68-year-old female artist with a large gay audience. This is quintessential Madonna, and her gay audience is loving it. Why she matters now more than ever Every moral panic surrounding her career revealed less about Madonna herself than about society’s anxieties about female autonomy. Whether discussing gender, religion, sexuality, material consumerism or ageing, she has both ignited and contributed to society and culture’s big conversations. In her recent interview with Graham Norton for the BBC, her audacious nature shows no signs of slowing down; she persistently pushed back on his questions, and was quite clear when she did not want to answer. It is rare to see anyone be so confident and assured in their own skin. Many would want to appear likeable and hope for a positive reception so the audience would be warmed up to buy the record, but Madonna is less polished popstar and more confident rockstar, her answers felt more like those of Ozzy Osbourne, Jonny Rotten and Liam Gallagher in their swag and attitude. Not every artist should aspire to be Madonna. But every generation needs an iconoclast: someone prepared to risk popularity in pursuit of possibility and to ignite debate and conversation. You might love her or hate her, but in an age increasingly governed by algorithms, metrics and carefully managed authenticity, that may be Madonna’s most relevant legacy of all: queer-infused female audacity. There is no one like her, and she is needed now more than ever. Chadwick Boseman’s death from colon cancer in 2020 shocked his fans. The actor and playwright, best known for starring in Marvel’s first “Black Panther” movie, worked throughout his private battle with the disease. Six years after he died at 43 without a will, he is back in the news because of a dispute among his loved ones. Boseman’s two brothers have asked a judge to remove his widow, Simone Ledward, from managing and settling the estate. They also want the judge to hold Ledward in contempt of court. They claim that the resolution of his estate has stalled due to delays, poor communication and mismanagement. Ledward has not yet responded publicly to these claims. This family feud involving a celebrity highlights three legal issues that intrigue us as scholars of inheritance law. First, when someone dies without a will, their property passes to heirs in accordance with their state’s laws. Second, putting one heir in charge of an estate can create friction with the other heirs. And third, judges can remove that person for serious misconduct. Spouses don’t necessarily inherit everything You might presume that when someone who is married dies without a will, their surviving spouse automatically gets everything. That’s not always true. Every state has its own intestacy statute. Those laws establish rules determining who inherits property when someone dies without a valid will. They vary considerably. In California, where Boseman died at his Los Angeles home, the law divides the property of married people into two categories known as “community property” and “separate property.” The surviving spouse inherits all of the couple’s community property, which generally includes assets earned during the marriage. But Chadwick Boseman married Ledward Boseman only six days before his death, although they had been involved in a long-term relationship that they generally kept quiet. When a Californian dies after a marriage that didn’t last long, there is not likely to be much community property. So the fate of separate property, which generally includes assets acquired before marriage or received by gift or inheritance after a couple ties the knot, becomes very important in those situations. If a California resident dies childless and without a will while their parents are still alive – as was true for Chadwick Boseman – their spouse gets only half of any assets classified as separate property. The rest goes to their parents. That appears to be why Carolyn and Leroy Boseman, the actor’s parents, have a financial interest in the estate despite his marriage. However, the couple assigned their inheritance rights to Kevin Boseman and Derrick Boseman, Chadwick’s brothers. Boseman’s widow is playing that role because California law gives the surviving spouse first priority to administer the estate. All of this takes place in probate court, which is where estates are administered. That means Ledward Boseman is playing two different roles. She’s one of the heirs entitled to inherit a share of Chadwick Boseman’s wealth and future income generated by his intellectual property. And she’s the estate administrator responsible for managing the estate as a whole. Wearing both of those hats can create conflict because heirs often disagree over whether the person managing the estate is acting for the benefit of everyone or favoring their own interests. That’s why disputes over executors and other estate fiduciaries are among the most common issues raised in probate litigation. As the court-appointed administrator, Ledward Boseman owes fiduciary duties of loyalty and impartiality to all heirs, including Boseman’s parents and their assignees, Boseman’s brothers. That means she cannot favor her own interests over theirs. She must also maintain accurate records, keep other heirs reasonably informed and distribute the estate’s assets according to law. Planning ahead helps after you’ve gone Writing a will and thinking carefully about who should manage the estate can help loved ones stay out of disputes like this. For example, if your relatives tend to bicker, it may be better to choose a neutral person instead of one of your heirs to manage your estate. A lawyer, accountant or professional fiduciary – someone with expertise regarding the handling of estates – may be more likely to earn everyone’s trust than someone who stands to inherit some or all of your assets.
