  • A Crash Course in Disabilities and What the Term Means

    You have probably heard the term “disability” before. Some individuals don’t like that word, and they might call themselves something like “differently abled.” No matter what term you choose to use, though, there’s no denying that such conditions remain very common.  About  1 in 4 US adults has a disability . If you think about that, it makes sense that companies such as those that make wheelchairs, canes, and walkers do very well for themselves.  In this article, we’ll talk a little more about disabilities. We’ll discuss what most people mean when they use that term. We’ll also cover how you might react to someone with a disability to avoid offending them.  What Does “Disability” Mean? Sometimes, individuals don’t agree on what the term “disability” means. We can still define it in the broadest possible sense, though. Generally, when someone uses this word, they mean a situation where someone has an impairment. That can relate to either their mind or body.  This impairment or condition usually makes it more challenging or even impossible for a person to do something that many other people can do. In other words, a disability limits or prevents an individual from doing something, or many things. If you find that someone has participation restrictions, that probably means they fit the legal definition of having a disability.  How Can You Tell Whether Someone Has a Disability? If defining “disability” sometimes becomes a little problematic, identifying someone who has one runs into complications even faster. If you see someone in a wheelchair who you know can’t walk without it, you can probably say they have a disability and not ponder the details much further than that. However, you might also meet someone who feels they have a disability according to the ADA (Americans with Disabilities Act), but you wouldn’t know it from their appearance or actions. In short, without asking someone, you can’t tell whether they have a disability or not. We already mentioned that some mental or psychological conditions legally constitute a disability.  You may have a situation sometimes where an individual might park in a space designated for individuals with disabilities, but they seem able-bodied when they get out of the car. It’s never okay to chastise them, though. You have no idea whether this person meets the legal definition for having a disability.  For instance, someone who has received a PTSD diagnosis  might look fine and act in what you’d consider a normal fashion. They still meet the criteria of having a disability as defined by entities like the Social Security Administration and the US Department of Veteran Affairs.  Because of these situations, it’s best to proceed with caution when making any assumption about someone’s disability status. They might have what look like significant and immediately noticeable restrictions and not consider themselves in the category of individuals with disabilities. They may look completely “normal” but still have a disability according to any recognized version of the term.  Can Someone with a Disability Lead a Normal Life? Some people also ask whether individuals with a disability can lead a normal life. Again, the very term “normal” has become problematic in some circles. That’s because there’s no real or accepted definition of normalcy. It’s accurate to say, though, that human beings can demonstrate extraordinary resilience sometimes. You might meet a soldier who stepped on an IED and lost both legs. If they’re resilient, they might still live a meaningful and rewarding life without those appendages for many years afterward.  In that respect, you can say that yes, many individuals with disabilities can enjoy their lives  and seldom or never feel sorry for themselves. You can’t assume anything about anyone, whether they appear able-bodied or of sound mind or not.  Instead, it’s best that you approach each individual without thinking anything about them beforehand based on what you see or what someone else may have told you. By judging people on their own merits , you can avoid awkward situations where you thought someone couldn’t do something because of how they look or what you assumed about their capabilities based on a first impression.  How Should You Treat Someone with a Disability? This leads directly to the question of how you should treat someone who has an obvious disability or says they have one. Just like every other human being, you might have someone with a diagnosed disability who’s perfectly pleasant and lovely to be around. It’s just as likely you’ll meet someone with a disability who’s positively insufferable.  You must give each person you meet the same chance to establish their identity, and that’s true regardless of whether they have a disability or not. However, in some situations, ignoring their condition doesn’t make a lot of sense, either.  If you’re going to an event, for instance, and you know you’re attending with someone who needs a wheelchair to get around, it’s not out of line to ask if you can do anything to assist them with their accommodations. If they respond favorably, you can help. If they seem defensive, you can back off the issue. Many individuals with disabilities , especially the obvious ones, will appreciate that you’re aware of their condition, but you’re also not dwelling on it. No two people probably feel exactly the same about how they want someone to react when they notice their disability. However, you will seldom go wrong by acknowledging such circumstances but not making them awkward.  Since so many people have disabilities, the sooner you can learn to accept those who do, the better off you’ll probably feel. If you want a diverse and expansive friend circle, you should never exclude anyone. It’s even possible that you can learn some lessons from differently-abled individuals that you can’t from those without disabilities.  Some have ways of looking at the world that are positively inspiring.   • Understanding Nerve Damage and How It Can Affect an Injury Claim

    You expect to suffer some types of injuries after an accident; broken bones and contusions are some common examples. An accident can also result in a traumatic injury that impacts the rest of your life. An injury that’s not often listed on a personal injury claim is nerve damage.  Your accident can cause one or more of the different types of nerve damage . So, what are the types of nerve damage and are there symptoms? You may also be wondering if you can file a claim if your nerve damage is caused by someone’s negligence. The Different Types of Nerve Damage Your central nervous system  plays a vital role, controlling everything from your breathing and muscles to letting you know if you’re hot or cold.  Your nerves are also responsible for carrying sensations from your body to your brain. Your nerves let you know when something tickles, feels painful, or is pleasant. When you’re dealing with nerve damage, your quality of life can be significantly impacted. Nerves are typically divided into three categories: Autonomic nerves that control functions like blood pressure, heart rate, digestion, and body regulate body temperature. Sensory nerves relay information to your brain concerning sensations felt on your muscles and skin. Motor nerves control your muscles by passing information from your brain to your spinal cord. Each group of nerves serves vital functions that help ensure you’re able to live life to its fullest. Symptoms of Nerve Damage Your symptoms can vary depending on which groups of nerves sustained damage and their location.  Remember, your nerves are part of your central nervous system and connect the various muscles in your body to your brain. Nerve damage in your arm often produces different symptoms than the ones controlling your heart rate. Autonomic Nerve Damage Symptoms Common symptoms associated with autonomic nerve damage can include: Lightheadedness Dry eyes and mouth Constipation Loss of bladder control You may also be unable to detect any pain or discomfort in your chest, for example, a heart attack. You may also have difficulty controlling your body’s sweat glands. Another less talked about symptom is a loss of sexual function. Sensory Nerve Damage Symptoms There are some symptoms specific to sensory nerve damage, including: Pain Sensitivity Numbness Tingling or prickling Burning You may also experience symptoms associated with other types of nerve damage. For example, your numbness may be commingled with a feeling of lightheadedness. Motor Nerve Damage Symptoms On top of this, there are certain symptoms for motor nerve damage: Weakness Muscle atrophy Twitching In some cases of motor nerve damage, patients have reported difficulties with spatial awareness. They can’t always accurately judge the distance between a space. The individual may feel like there’s plenty of room on the couch, only to sit down on someone’s lap. Seeking Compensation for Nerve Damage Certain diseases like some forms of cancer and diabetes can cause nerve damage. Substance abuse can also damage your nerves over time. Being involved in an accident can also damage your nerves.  If the accident is caused by someone’s negligent behavior or actions, there’s a good chance you can file a claim to receive compensation. However, you can’t simply fill out an insurance form and hope to receive a check in the mail. While this would be great, there’s a process you must follow. Document Your Nerve Damage One of the first things you should always do, after reporting the accident to the authorities, is seek immediate medical attention. Your nerve damage may not start to show signs and symptoms for a few days, but it’s always a good idea to be proactive about your health.  Even if symptoms aren’t apparent, your physician may be able to give you an early diagnosis. The sooner you start treating your nerve damage, the better your chances are of making a full recovery. You’re also going to need your medical records to prove your nerve damage is the direct result of the accident. Pick Up a Copy of Your Accident Report You’re also going to need to supply a copy of your accident report to the insurance company. Since your accident resulted in injuries, you’re legally obligated to report the accident immediately—this also means staying on the scene.  If you drive off, you may be facing a hit-and-run charge and this can affect your personal injury claim. Most accident reports are ready in about 7 to 10 business days and you can purchase a copy online  or head to the nearest police precinct. Calculate Your Damages Your damages will include your medical expenses. If you also suffer property damage or lost income, you can include this in your claim.  Don’t forget about your non-economic damages like pain and suffering. Your attorney can help you calculate these damages. Once you know the value of your claim, it’s time to contact the insurance company. Navigating Florida Personal Injury Law Florida follows no-fault insurance laws which affects your personal injury claim. Your PIP (personal injury protection) insurance will cover some of your economic damages, up to the policy’s cap. All drivers with vehicles registered in Florida must carry at least the state’s minimum PIP insurance requirements . Most PIP policies pay up to 80% of your medical expenses. So, how do you recover your remaining economic damages, and who pays for your non-economic damages? After filing a claim with your personal injury protection coverage, you can turn to the at-fault driver’s insurance for your remaining damages. This is why your attorney calculated your non-economic damages. Filing an insurance claim with the at-fault party’s insurance means proving negligence. Since you have a copy of the accident report, you’re all set to prove your claim. Something to remember is your claim against the defendant’s insurance company picks up where your PIP coverage leaves off.  So, if your medical expenses are $100,000 and PIP covers $25,000, your claim against the other driver will be for $75,000 in medical costs. You Can Receive Compensation for Your Nerve Damage Even though nerve damage isn’t commonly listed on personal injury claims, this doesn’t mean it can’t be included. Nerve damage can impact your quality of life, and you deserve to receive compensation.   • Pérez Fights Back For Hungarian Grand Prix Top-10 Finish As Tsunoda Also Shines

    Oracle Red Bull Racing's Sergio Pérez powered through the field at the Hungarian Grand Prix on Sunday to bag seventh place and join Dutch teammate Max Verstappen with an important points finish. The Mexican started 16th on the grid, however put pedal to the metal to slice through the field and claim six points as reigning three-time Formula One champion Verstappen earned 10 in fifth. Visa Cash App RB's Yuki Tsunoda also finished in the points thanks to his ninth spot, while Australian teammate Daniel Ricciardo was not far behind in 12th at the Hungaroring circuit. QUOTES Oracle Red Bull Racing MAX VERSTAPPEN - 5th "Today was a tough race for us so naturally that frustrated me as I want things to be better. If you look at the whole race I don't think we were fast enough; we unfortunately just didn't have the pace and the strategy wasn't working for us today. The high temperatures on the track also meant that the tyres overheated, especially when we were trying to overtake throughout the race, which was very tough. We got stuck behind cars and let ourselves get undercut and I think we just didn't have our best day. We had to fight our way back and lost so much time that we lost touch with both the McLarens. As the pace of the car wasn't as good, we really needed to capitalise on the strategy and we just didn't manage to do that today. I need to look back at what happened with Lewis but I committed to the move and I don't think I braked too late but we collided. I don't think we could have beaten McLaren today but, from qualifying yesterday, I did think that P3 was on the cards, so it is a disappointing day all in all." SERGIO PEREZ - 7th "I think that was the maximum we could achieve today; overtaking was impossible in the first stint on the hard. It was an aggressive strategy to begin on the hard and it worked well for us, from the start it was about putting it all together, making the right calls and the right progress. My Team had to rebuild the car overnight and it was not one hundred percent on set-up, some correlation was off, so it's positive I was able to feel at one with the car today and I am getting the feeling back, this is a good boost of confidence. The Team did an incredible job to get the car on track today after my crash, I need to maximise my own performance to match their hard work. The only thing that matters to me is my Team and the people working with me, I have to give my very best to them because they deserve it. I am here keeping my head down; I will keep improving and get back to my form. I think we have the pace to fight at the front, we showed it today and it is just a matter of time until we are back on the podium." CHRISTIAN HORNER - CEO and Team Principal "It didn't work out for us today. We seemed to have understeer and then losing that position at the start and conceding back to Lando affected us. We tried giving an overlap to give Max the pace but to no avail. The middle sector, in parts of the race was where we were looking competitive but there is plenty for us to look at to try and see how we can improve and come back stronger next weekend. Checo drove a good race today and his strategy, getting the undercut on George, worked well. He also showed good pace, made good overtakes and hopefully would have taken some good confidence from that for a strong performance in Spa." It wasn't easy after such a big crash and we had to change a lot of things, but because of their hard work we were able to score the points today - huge credit to the whole team. I'm very relieved I was able to make up for it after yesterday's crash and particularly happy with my tyre management. I think it was a big race for us, especially as we were able to finish ahead of our competitors, and it's a huge positive for the coming races." DANIEL RICCIARDO - 12th "Today it was a long and frustrating race. We didn't use the pace we had in the clear air. We were on the mediums at the start of the race and after only a few laps we pitted for new hards together with the other cars who started on softs, coming out in traffic. It's even more frustrating because we were quick all weekend, and I felt like we have taken ourselves out of the race so early as we couldn't fight cars that were coming much quicker on newer tyres." GUILLAUME DEZOTEUX - Head of Vehicle Performance "Yuki finished P9 and brought us two precious points which reward the hard work the team has put in overnight repairing his car from the crash yesterday in qualifying. Both cars had a good start but lost positions to the soft runners in the opening laps. Some cars started to pit early, and we reacted with Daniel, which put him in heavy traffic and did not allow him to use his pace. Anticipating his second stop allowed us to gain a few positions back and Daniel could show good lap times, but it wasn't enough to end up in the points for him and he finished P12. With Yuki, we decided to extend the first stint. His good tyre management and the consistency of lap times opened the possibility of doing a one-stop race, which is what we went for. This strategy allowed us to beat the two Aston Martins which is a great achievement, concluding this weekend on a high note." LAURENT MEKIES - Team Principal "Over the past few weeks, everyone in Faenza and Bicester worked hard and effectively, delivering the upturn in performance we witnessed here in Hungary. Getting both cars into Q3 was proof of that, once again heading the midfield and the points we picked up today are a well-deserved reward for all that effort. Yuki's race was sensational, and we were the only car daring to do a one-stop race, which allowed us to beat not only the midfield runners but also both Aston Martins. Yuki's tyre management was second to none, and he made it stick to the end. The team also did a truly remarkable job in a short space of time by rebuilding Yuki's car around a new chassis following his Q3 crash. Unfortunately, we got it wrong with Daniel and pitted him too early in heavy traffic, which lost him a chance to fight for points. His pace had been extremely strong all weekend long, and he demonstrated that again in the final stint of the race when he was finally able to find some free air and fight his way back. We certainly share his frustration, and we will learn and come back stronger next week. Now we move on to Spa, a very different challenge to the Hungaroring. We go there with the positives of our strong weekend here and will push very hard to get our car to work as best it can at this fast and flowing track." By ML Staff. There are 10 classes (class = type of boat / board): Women’s & Men’s Kiteboarding, 49er, 49erFX, Nacra 17, Mixed 470, Men’s & Women’s iQFOiL, ILCA 6, ILCA 7 (USA is not competing in the ILCA 7) WHEN WE SAIL Sailing at the Paris 2024 Olympics will take place from July 28 through August 8 (with August 9 as a backup day in case of bad weather). Below: Detailed Olympic sailing schedule   WHERE WE SAIL We sail on the Bay of Marseille in the Mediterranean Sea, a “satellite venue” located about 500 miles south of Paris. Each class completes their regatta on a “course” outlined using buoys. HOW WE RACE Racing occurs in one of four “areas” on the water. Within each area, a “course” is outlined using buoys that all competitors must sail around to complete each race. First around the course wins the race! The first boat to cross the finish line gets one point on their results sheet, second boat to cross gets two points, etc. Lowest score at the end of the regatta wins. This is the third time the Olympics will be held in Paris: first in 1900, then in 1924, and now 2024. In 1900 and 1924, sailing events were held in both the Seine and the English Channel / Atlantic. Marseille was selected for 2024 due to its exceptional sailing conditions, featuring a strong characteristic seasonal breeze, the “Mistral.” There are four race areas on the Bay of Marseille, all named after cities or geographical features around the area: “Corniche,” “Marseille,” “Frioul,” and “Calanques.” Separate race areas allow multiple fleets to compete on the water at the same time. Within each area, the competitors will all race on the same “course” outlined by buoys. Each type of course has a name; the one below and to the right is called an “Inner Trapezoid.” The first boat/board around the buoys and through the finish line is the winner of that race, with multiple races constituting a regatta. The race winner receives one point for that race, second place receives two points, and so on. The boat/board with the fewest overall points at the end of the regatta wins the event.   • Limestone Asset Management Closes On / Purchases Doral LA Fitness and Homestead Burger King

    On July 22, Miami-based Limestone Asset Management closed on two commercial properties in Miami-Dade County: LA Fitness at 10055 NW 41st, Doral, FL 33178 for $13.603 million and Burger King at 28644 SW 137th Avenue, Homestead, FL 33034 for $1.936 million.   The LA Fitness, built in 2001, is a 37,500-square-foot building situated on 2.3 acres of land. Built in 2008, the Burger King is a 3,005-square-foot building located on 0.7 acres of land.    Kevin Sanz, president of Orion Real Estate Group, led the buyer group. Alex Sharrin, senior managing director of JLL Capital Markets, represented the seller of the LA Fitness, Kireland 41st Street Doral, LLC; and the seller of Burger King, Kireland 137th Avenue Miami, LLC. There was no financing for either transaction.    “We are pleased to continue expanding our assets in Miami-Dade County,” said Ibrahim Al-Rashid, chairman of Limestone Asset Management. “LA Fitness and Burger King are strong tenants in some of the fastest-growing areas of the county.”   The LA Fitness is in a high-performing retail corridor.
